  • March 2018 filers: let's share our experience!!

    Hi all, I started this long journey November 2017. I got married with my husband (US citizen) at the end of January 2018 and I filed yesterday all my documents!

    Some info:
    Actual Status: H1B visa until 2021
    citizenship: Italian
    Application from: Dayton, Ohio.

    I shipped all the documents on Monday March 13th. I did it with UPS and I chose the 2-days delivery option since all the documentation was 4.3 lb! I put both our last three years tax return and transcript from IRS including for both 2017 tax return.

    Forms file: I-130, I-486 (including I-693 and I-864) and I-765

    If interested I will attach the letter I sent with the applications. I did not use a lawyer, I found a lot of info (and support!) in this website.

    Any questions about my applications please let me know, the est approach is to help each other.

    I am filing by i130 and have question on following -- If the beneficiary's native written language does not use roman letters,type or print his or her name and foreign address in their native written language

    My native language is Indian so I will write my name in my native language. For Foreign address, Which address should I enter ?

    Last Place where I live in India or My parent;s address in India

        Did you send 2017 W-2s or 1099s with the Form 864 or 2017 Tax Return? If you did not. You will receive an RFE as I have received one for "Request for Most Recent Tax Year w2s or 1099s or All tax schedules" when I filed on 01/25/2018. I am just giving you a heads up so you can get a more time to collect the documents when you receive RFE.

        I filed on 01/25/2018 and RFe received on 02/16/2018 requesting for "Evidence of Most Recent Tax Year" Please if possible attach 2018 (Current Year) Paystubs and Employment Verification Letter from your Employer while you response for RFE. (To avoid Another RFE)

        I don't mean to scare you (as Its nothing to scare about) I am just sharing my Experience so you can have some more time to collect the evidence.

            He/she sent IRS transcripts. This is straight from the I-864 instructions.
            "If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income."

            They love using double negatives. I sent in faxed IRS transcripts and filed a joint income tax return with my spouse - using only my income to qualify. Thus, I sent in W-2s and all schedules, just to be safe. To me, it sounds like he/she should be fine but it's USCIS, and you just never know, I guess.

              Hi, thank you. I actually didn't send 2017 because at the time I hadn't filed my taxes. My spouse won't be included because he doesn't actually work. He goes for his biometrics appointment on 03/20/2018. Then we'll be waiting for he EAD so he can work.

                  03/16 file

                  My husband and I filed his packet yesterday, 3/16. Due to extenuating circumstances, we weren't able to file as quickly as we'd hoped we would. He's been here since Jan 4 and has to leave by April 3rd... at what point is he ok to stay once the paperwork is sent in? Im worried nothing will move with the paperwork before the date he is supposed to leave.

                            This is a bit nerve wrecking because usually they take up to a week or 10 days. You can call the USISC and check if you were assigned a case number already. THey usually tell you to wait 10 days before calling so you can already.
