Working on Side Project While on TN

1) Is it legal to work on a project while on a TN visa during my own time, and eventually if it looks like it is gaining traction as a non-business entity, once the TN period is over and I have returned to Canada, then turn that product into a business in Canada?

2) Is it legal to start a Canadian business, work on a TN visa for a company within the US, and work on the Canadian business while in the US working for a US company?

My understanding is that the second is not legal, but I am not sure about the first scenario.

Theoretically it's illegal to work for free even, but if it's a "hobby" then I don't see the issue.
