  • Can my parents visit me on tourist visa while I-130 is pending?

    I am planning to apply for 1-130 for my parents. They have valid tourist visa. Would they be permitted to enter USA on their visa if I-130 would be in process ?

    Yes, you can file vistor visa for them . No isssues

      It is possible that your parents could be denied entry on a tourist visa if you have filed an I-130. A tourist visa does not allow dual intent, meaning that once you have indicated to USCIS that they plan to come to the US permanently, they can be denied entry on a temporary visa. Unfortunately this is something that is to a large extent at the discretion of the CBP officer who handles their entry at customs when they arrive in the US, so there is no way for you to know with 100% certainty whether they will be allowed entry on the tourist visa.
