Hi Everyone,
I have the following situation and with the lot of fuss going around H4 and EAD, I am looking for some guidances as to what might be more appropriate path.
- my wife H1b is valid till sep 2019.
- her employer is closing business soon, so she will loose her H1 status if no other employer offers her a job., lets assume Aug 10th.
- I have my i140 approved and H valid till 2020.
- she is waiting for interview results from 1-2 employers,again no idea when they will call us, lets assume 15 days from now.
1. In this case,is it a better idea to wait and hopefully an employer offer her a job before Aug 10?
2. or we should file H4 COS and H4EAD for her, and wait for these two to get approved.?
3. What if we do #2 right now, and while we submitted the application to uscis, say by Jul 30th, one of the employer approaches and offered her a job
on Aug 7th and she can start new job by Aug 20th.
a) will she risk going out of status for that short time, if we wait?
b) should we be able to continue with the offer even though the COS application is submitted/pending?
c) or shall we let the employer know that EAD is submitted, and ask if employer can wait for a month?
