  • I- 140 EB-2 Pending

    I have case pending at USCIS Texas since September 13th, 2016.
    RFE submitted in the December 2016.
    Name updated in May 2017.
    I submitted 2 inquiries this year 2018, the answers from USCIS are that my case is with an adjudicating officer ( 2 times) , How many times a case has to be submitted to an adjudicating officer ?

    I am kind of down now , any suggestions for my case ? or any similar histories ?

    They shouldn't take longer than the estimated processing average case time.

    One option is to sue them using a Writ of Mandamus to press for an answer under the equal treatment and Administrative Procedures Act.

    They take so long these days and I think its all the crazy checks that they have to do,

    It used to be much easier when they had one officer in the embassy who could answer questions directly. The internet is supposed to speed things up but i don't know what is going on these days.

    I too am very tired of waiting for 22 years and I think I have just about decided to leave the USA for good. It is so expensive to stay here and you have no priority for anything good as a non citizen and companies try to exploit you.
