  • Question about expediting 765 process

    Hello

    Me and my wife filed concurrent NIW (140, 485, 131, 765), RD is Aug 31 2018 and PD is Sep 21 2018, Texas Center (SRC1890663xxx). I'm F1 holder, and my wife is F2 holder.

    My current EAD (F1OPT) will be over pretty soon, but there is no news from my current 765 case. I'm working as a university post-doc in engineering field, working on DoD project, and have a family (spouse + 1kid).

    Since I'm working as a university post-doc, I'm not sure how to prove university or my adviser will have severe loss. And I know no one to write an expediting letter from US government. So, it seems that my expediting reason will be personal financial hardship. I need to pay rent, insurance, and etc. My wife is F2 so she cannot work, and I cannot work without valid EAD card.

    Here is my question:

    1) To expedite, do I need to write a letter to congressmen, from the link "help with Federal Agency" from their webpage? Or do I need to directly contact USCIS by phone or via my lawyer?

    2) When applying for expedite, what evidence documents should be prepared? Monthly bills and bank account will be enough?

    3) How long it usually takes?

    Sep.21.18 = Priority Date
    Dec.07.18 = Spouse biometrics done
    Jan.28.19 = Biometrics done for me
    Jan.29.19 = Fingerprint Review Was Completed
    Feb.07.19 = EAD expedition request to congressmen
    Feb.14.19 = Send expedition evidences to congressmen office

    From what I have been reading, it can take 1-2 months, depending on the Congress office. I contacted my senator and I sent my bills, credit card statements, car loan payment and insurance bills. I’m still waiting for them to reply.
    My timeline below. Category:C9.

    10/9 package sent
    10/11 package Recieved/ priority date
    10/17 Bio Fees accepted (notice from the App) checks were cashed
    10/22 received notices in the mail.
    11/01 Bio appt schedule notice received. 11/14
    11/9 I-693 Courtesy Letter received
    11/14 Bio Appt completed at the La Brea Los Angeles Office
    11/29 Fingerprints review was completed
    3/4 EAD card being produced
    3/9 EAD Card Recieved
    3/11 case is ready to be scheduled for interview

      Thanks to share. May I ask what is your PD and when did you start expedite? How long would it takes to get answer from congressmen office and from USCIS?

        My PD is October 11. I started the expedite through senator on 1/5/19 and on 1/25/19, senators office sent me USCIS response that my expedite case was denied. Their response was that they are requiring a job offer or a letter from current employer saying that the working permit is needed or else employment will be terminated
