  • California residency H4 vs. EAD

    I used to be on H4 till sometime earlier this year. I got my EAD approved last year (I-485 filed in July 2007). Now the school (CSU East bay) says that they cannot qualify me for residency as I do not have a H-visa (H1 or H4) anymore. When I mentioned my EAD status derived from a filed I-485, they say that they need proof that the EAD was indeed from a I-485 and not from a F1 or political asylee or some such procedure.

    Has anyone had any such experience ? Also, what proof can you provide (beside EAD) of you 'pending AOS' (ie, filed 485) status ?

    EAD will have C09 on it and that means it is from a 485. Unless you or your spouse used EAD, you will continue to maintain H status and will not be a parolee.
