  • OPT 90 day rule Clarification on Unpaid Employment

    Hello,
    I was offered employment by a company in the silicon valley for unpaid , volunteer based employment . This company deals in a line of business directly related to my field of study .
    This would mean i would not be on their payroll. I would be assigned to one manager who i would report to.
    Can anyone give me their views on whether i must take this offer??

    The reason partially is also that my OPT has begun and the 'days of unemployment' are ticking already for me!

    This is what i found .The rule says the student must be able to show evidence that he/she worked atleast 20 hours per week during the period of employment. But how should i account for 20 hrs of work if i am not going to be on payroll?

      You can get a letter from your employer stating that you worked more than 20 hours and that it was related to your field of study.
      This is my opinion and not legal advice.
