Travelling to India for Vacation holding OPT and H1 Lottery waiting for Petetion.
Hi All,
My wife planing to travel to India next month(september 1st week) , having below questions. Please help me providing some info or any suggestions.
1) She is having OPT valid till mid of november-2015 ( working through X-employer)
2) Currently working in a company.
3) 2015 H1B case picked in lottery (H1B filed by employer-Y) but still waiting for petetion approval ..
Question1 : Can she travel to India in September ? Was there any problems to H1 petetion since it is not yet approved?
Question2 : If she wants to travel back before oct-1st with her OPT status - Was it advisable ?
Question3 : If she wait in India and get the H4 and travel is best option ? (I don't have H1 stamped , need to go India and get it stamped)
