  • Setting up a branch in US do we need L1A or L1B

    We are looking at setting up a branch of our business in the US and are wondering which type of Visa we should apply for. We understand that it needs to be either L1A or L1B.

    The founder of the company who is a Director is looking to set up the branch himself and start off with taking part in the training until such time that we can train others to do the job.

    I wanted to know if :

    L1A (Managers and Executives) can be obtained for a business that does not already have an active branch in the US? Do we have to have had a US branch that has been operating for one year before we can use the above visa to send someone over? Can we send him over to set up the office?

    Is the Director able to take part in the training as well as managerial duties.

    Do we need to form a company first to get an office?

    Would we be better off going for L1B visa based on the fact that the person going over would be specialized in setting up the business exactly as we have here in the UK and would be able to test the market to see if there is potential, hence hire a team to take over.
