I am currently in the US staying for a b1/b2 visa I-94(3 months stay). My employer would be filing for an E1 visa for me. My question is would I violate my I-94 for overstaying just in case I have not yet received my E1 approval before my I-94 expiration? We would be filing sooner before expiration of E1. My employer said that its okay to stay as long as we filed for E1 before the expiration of I-94 B1 and as long as the immigration received the petition by before my I-94 expires. Many Thanks.
