  • Can I file a N400 after my resident card expired?

    Thanks for your time.

    My permanent resident card expired over a year ago. I did not renew it because I planned on filing my N400 instead. I am now doing it after it took a while to get all my documents ready. It did take too long I agree.

    I don't know if I can submit the N400 or if that will be rejected and I'll be asked to do the i90 first? I am getting different answers from other places I've looked including talking to an attorney. Thank you.

    To file your N-400, your Green Card must be unexpired, or you must have a receipt notice for submittal of the I-90.

      Thanks for the reply. So I don't have to wait for the i90 application to be approved then? This is the first time I've heard of just having the receipt for it. Thanks

        My mistake. Don't file N-400 with receipt unless it is receipt for lost Green Card. If your card was expired, don't file N-400 unless you have new card. I am sorry for misinformation.
