  • My Citizenship Chances? 3 or 5 Years?4 years?

    Hi! I got my permanent green card on 7/22/17 at the time I was married to a US citizen (we had been married for about 7 years by then). We got divorced about a year after I got the green card, and i got remarried shortly after that. (To a US citizen)

    The question is do I qualify for the 3 year? do I wait 4? (by then I would have been married to the same US citizen for 3 years)
    I should add that for the first 6 years that I was married to my first wife my status was undocumented .

    You can file under the 3-year rule once you have been married to your current spouse for 3 years (assuming your spouse has been a US citizen for 3 years).

    However, if it is very close to when you qualify under the 5-year rule (i.e. when you will have been a permanent resident for 5 years, and you can apply 90 days before that), it might be simpler to apply under the 5-year rule as it requires less evidence about your marriage.

      I have only been married to my current wife for 2 years. And yes she was born here so she has been a citizen for as long as she is been alive.
