  • Filling N400 after i751?

Hello guys, I have a few questions. I am filling i751 on Jan 21, 2022 (3 months before my 2 year residence expire so April 21, 2022), and I would like to apply for n400 as well but my questions are:

    - When is the right moment to apply for N400? I will be 3 years married to same uscitizen on Jan 14th, 2022
    - Or Is that the right time to apply for N400 after submitting my i751?
    - Do I have to submit my N400 before April 21,2022 to qualify,?

You qualify for naturalization under the 3-year rule if: you have been continuously resident as a permanent resident for at least 3 years, you have been married for at least 3 years, and your spouse has been a US citizen for at least 3 years. You can file N-400 up to 90 days before meeting the continuous residence requirement, but all other requirements must be met at the time of application. It seems from your description that you have already met the married for 3 years and spouse being a US citizen for 3 years requirements. Right? So you need to wait until 90 days before you will have been a permanent resident for 3 years, which should be Jan 21, 2023.

This is my personal opinion and is not to be construed as legal advice.
