  • Two-year rule for internship in a government laboratory

    Hi all,

I have been offered an internship (and a postdoc if everything goes well) in a U.S. Dept. of Energy national laboratory. I will be issued a J-1 Visa and I am worried about the two-year requirement.

The following conditions will apply to my internship:

    1) The lab is property of the US Dept of Energy. However, the internship program to which I'm partecipating is not intended for cultural exchange. American citizens could apply to that position as well, and I'm the selected candidate among the applicant pool. I will be an employee of the lab, and receive a salary.

    2) During the internship, I will not receive a scholarship, a salary or any other kind of funding from my university (I'm a PhD student) or from my home-country government.

    3) I come from a western, European country which is not in the "skill list".

Could I be subject to the two-year rule, due to the fact that I'm going to work for a government laboratory?

    Thank you.
