I am on J1 visa which will expire in September. I have a B2 visa which I used only once prior to my J1 visa. My J1 visa has a 212e. I am applying for my waiver. Assuming that the processing times will take a little longer than the normal time, can I still stay in the US and apply for status change?

I believe you cannot do Change of Status from J1 unless you are not subject to the 2-year home residency requirement (or it has been waived). But you can leave the US and re-enter on your B2 visa at any time (by air, since land borders are limited to essential travel); the 2-year home residency requirement does not restrict entry on nonimmigrant visas other than H or L.

Hi prajaiprabhu, Have you already applied for the waiver? did you apply at the indian consulate in new york? I am having trouble applying for NORI III at new york using the online application system.
