Does anybody have any idea of what the status going to be, if a tourist visa holder gets married to a 4 1/2 years US immigrant (green card holder) and is in the process of process of applying for a US citizenship? Does the status tourist visa change to US immigrant or something else? Or, is this even legal?

Open to any suggestions or advice.

Are you in the US if so you can marry,how long does he have to wait to be eligeble for citizenship, does he fall into the 3 year or 5 year waiting category, if he falls into the three year he can file now and as soon as he gets through he can file for you, if he falls into the five year, then as soon as he is eligible which can be 90 days before the 5 years you can go ahead, or you can marry now and upgrade with the I485, when you become a citizen.

Another question is that she is eligible to apply for US citizenship the sametime my I-94 expires. If we get married now and my I-94 expires before my case gets processed do I need to go back out of the USA?

Am I still leagal to stay in the US? Do you recommend us talking to an immigration lawyer? What are your recommendations as far as who to talk to.
Need your advice.
