Hello all,
I visited an immigration officer today and explained our situation to her. In less than 2 weeks i will purpose to my Ukrainian girlfriend!!! (excited!!!) Here is what we are concerned about. In 2007 she came, along with her mother and brother (k1/k2 visas) so her mother could marry this US citizen. She was married within the 90 day limit but the kicker is that he never, even to this day adjust their statuses. Financial reasons from my understanding. In 2009 my girlfriend voluntarily left and returned to Ukraine and has been living there ever since. So as i find out today from USCIS officer that her 2 years and 4 months according to my girlfriend were unregistered therefore she was here illegially. She visited 3 immigration lawyers in Georgia just before going home and they told her as long as you return before your 21st birthday she would be fine. So i really dont understand who to believe. What we want to know, when its time for the interview in Keiv, is this 2 year 4 month period going to haunt us? I asked the immigration officer this same question and she said nothing is for sure it just depends wether they find that a serious offense. She also said what they will manily look at is us as a couple and to see if our relationship is bonafied. She said show lots of proof! And we do have quite a bit! This will be my second trip there and have save everything you can possibly think of as proof. I just hate knowing our hopes and dreams will be cut short due to this factor. Any hints or tidbits of advice when she gets asked if she lived in the US? Purpose of visit? And reasons for going back home? Like the immigration officer said there is plenty of hope. I sure hope she is right. Please, any imformation on this would be very beneficial to us!!
