H1B petition expired and cancelled by employer. still eligible for Cap exemption?

I have an approved H1b from 2009 cap, but it's expired by Sept 2012. My employer had cancelled my petition. And now, can same employer file a new H1 petition under cap exempt?

Yes, you will need a copy of the receipt, approval or at minimum the receipt number.
