Extension under Cap-Exempt in Nov 2011 and petition got approved in Feb 2012

  • Extension under Cap-Exempt in Nov 2011 and petition got approved in Feb 2012

    My Case:

    My First Petition was made by my employer in 2008 and this was expired in Sept 2011. I did not even go for stamping bcz of family reason.
    Now again same employer filed for my extension under Cap exempt in Nov 2011 and my petition got approved in Feb 2012 which is valid till Jan 2015.

    Now I do have 2 different Petition Receipt Numbers:
    1)Through First Petition applied by my employer in 2008
    2)Second through same employer who filed for my extension under Cap exempt in Nov 2011

    And according to the Mandatory Documents for H1B visa applicant listed on https://www.immihelp.com/h1-visa-stamping-documents/.
    They ask for =>I-129 Petition Receipt Number, printed on approved Form I-129 petition and copy of your Form I-797 approval.

    Now my question is - Which Petition Receipt Number should I consider. In my recent I-129 Petition the original Petition Receipt Number(Through First Petition applied by my employer in 2008) is mentioned or Consider the Recent Petition Number.

    I am little bit confused here. Members can you please help in my case...

    Note: I have my OFC appointment scheduled on Sunday, 22nd Oct 2012 and Visa appointment scheduled on Monday 29th Oct 2012.

    Members your immediate help is required....in my above case...

          Salary in my Employer Letter

          Thank you Kabaka for your response...

          Going ahead on my case:
          =>My Salary in US will be $45K/Annum in my employer letter.
          =>I have done my masters. Usually the minimal salary should be according to laws on H1B will be $60K/Annum.(I am not sure but I read somewhere)
          =>I am working for my employer only at US locations(I say...In-house type?)
          =>My base location in US will be VA and and also going to NJ on an often for presentation and meeting.
          =>Both the VA and NJ have less wage than $45K/Annum. Also LCA is expiring in Jan 2013(Note: I have my OFC appointment scheduled on Sunday, 22nd Oct 2012 and Visa
          appointment scheduled on Monday 29th Oct 2012.)

          Questions:

          1)As my salary is $45K/Annum, does it is going to make any effect on vo decision?
          2)As in LCA both the location has marginally less wages than my current wage($45K/Annum). Does it is going to make any effect on vo decision?

            Wage is fine as long as it is as per certified LCA.

            But practically 45k will not be a lavish wage for you. You may not be able to save a lot.

            Rest seems fine.

              Also now what questions shall I expect from VO similar to my case. OR How shall I fight my war without weapon(Any questions/answer you can suggest) if you come across similar cases in the past...
