  • Administrative processing - changing status from H4 to H1B

    I was working in USA with L2 EAD and got my H1B petition approved. I came to India on Aug and went for H1B stamping on Sep. I was given a pink slip and the administrative process status is still showing "Pending Process". Meanwhile my husband also got the H1B approved and got the visa stamped.

    My question is whether it is possible for me to travel with him as his dependent (H4) and once the administrative process for the H1B is approved, can i change the status being in USA itself?

    Yes, you can travel to US in H4 status. You can even apply for change of status while in the US. Remember that the 221g will need to be mentioned as denial in your H4 application.
