Hi:
I plan to bring my wife over on a H4 visa, the Visa appointment is for the Sep of 2005. My H1 expires Dec 2005. My renewal has been filed, but is expected only towards end of December.
1. Will this be a problem when she goes for Visa interview in Sep. I have all the documents needed.
2. If she gets the H4 Visa when can I file for the renewal of her H4. Do I have to wait till my H1 is approved and then file, or can I file it as soon as she gets here.
3. If I file H4 renewal after my H1 approval, she will be out of status (Her h4 will be valid only till my H1, ie Dec) till her H4 is approved.
4. I understand the I just have to file I-539 for the extension of stay for H4 renewal. Am I right?
