  • To go for H1 stamping or not?

    Hi Experts,
    I'm currently employed with a US mutlinational. My visa status is H1B.
    I applied for extn and got I797 valid till Mar 2014. But I94 on my passport expired. The last time I was admitted into the US on a H1 stamp.

    Now I have received EAD and AP as a part of my husband's GC process. I have not initiated GC process for myself.
    I'm travelling to India in Dec. My queries are

    1. When I return to US can I be admitted in as a Parolee (using my AP)
    2. If the ans to question 1 is yes, then does that mean I dont have to go to the Indian consulate for stamping(I would be very happy if that is the case
    3. If I re-enter on AP, can I continue working with my company using my H1 status

    -- You don't have to apply for H1 Visa
    3. If I re-enter on AP, can I continue working with my company using my H1 status
    -- No, you will need to work using EAD not H1 since your status then will not be H1.

      Thanks a lot for responding.. So if I re-enter on AP is my H1 cancelled or voided

        The petition is not canceled, but you just won't have H1 status.
