  • New Employer, valid I797, expired H1 B- Stamping Question!

    Hello,

    I have an H1 B stamping that expired in Oct 2010. I have always had legal I797 extension papers validating my stay in the US. I changed my employer on 03 Dec 2012 (Last week) and the new I797 has a validity until 2015. I have a personal situation that needs me to travel to India end of the month.

    As I have to get my H1 stamped before re- entering the US, I am worried about the fact that I will have been with this company for just 1 month (Only one pay stub from this employer). Does anyone of this board have similar experiences or information that can help me?

    Is it better to stay here in the US till I have worked for this employer longer or can I go for the visa stamping? My current employer is a big and fairly well known company.

    Any experiences or information is appreciated!
