  • Problems with never getting H1B stamped

    Hey all,

I'm currently in my first year of H1b. I had a change of status from F1 to H1b without completing PhD.
I have not got H1B visa stamped on passport; still have F1 there.
I'm hesitating to go back to India to get it stamped because I'm afraid they might send my application for admin processing and delay it.
Hence, I plan to spend the next couple of years in USA before my company applies for green card.
I plan to never leave the country.

What are the consequences I might face if I never get H1 stamped?
Will it affect my H1 renewal or green card process (in future)?

If at all I must get my H1 stamped, would Canada be a better option than my home country India.

It does not matter. You only need the Visa if you are outside the US and want to travel to US. You can stay in the US as long as your latest I-94 allows.

Also, you will not be able to travel to any other country (except Canada and Mexico for short trips) unless you have a US Visa to return.
Having said that, in some non-immigration situations such as getting a loan, banks may ask for Visa and since bank officials are not familiar with the technicalities, they may deny your loan.
This is my opinion and not legal advice.
