  • Transferring a cancelled H1B visa

    Sir,

I got H1B visa but never travelled to the US after the stamping. Now the sponsor has revoked the visa.
Meanwhile a new sponsor has come forward to transfer the visa. I did not tell the new sponsor about the revocation of the visa.

I checked my case status today and found the below current status:

Post Decision Activity: On January 3, 2013, the previous decision made on your case was revoked and we mailed you a notice explaining the decision.

    Kindly clarify the following:

    1. What is the current status of my visa means?

    2. Is it possible to transfer the revoked H1B visa?

    3. Do I have to inform my new sponsor about my visa revocation as he is going to apply for visa transfer?

I would appriciate a prompt response.

    Thank you in advance.

    Regards,
    Tony

Another employer can file a cap-exempt petition for you at any time. It does not matter that the previous petition was revoked.
This is my opinion and not legal advice.

      New sponsor unware of cancellation

      Thank you.

My new sponsor, who is going to file transfer, is not aware of the H1B revocation by old sponsor.
Do I have to inform my new sponsor about the revocation?
Does the new sponsor has to mention about the revocation in the new transfer application?

      Thanks is advance.
