  • H1B beyond 6 years - I-140 approved

    Hello,

I am working for company A (US based MNC) on H1B since last 4 years. Company A has filed my labor and my I-140 is approved. I have a priority date of Nov 2010 (which I believe is not so near as of now). My company filed my H1B extension based on my I-140 approval and thus I have my H1B till Nov 2014 from Company A (I got a 3 years ext.).
Now, I am planning to change my job. I have following questions:

    1. If I plan to transfer my H1B to another company (say B), will I get H1B for another 3 years or only till Nov 2014 (H1B expiry date of Company A)?
    2. If answer to the first question is Nov 2014, then is there a deadline by which company B has to start my labor?
    3. If Company B agrees to start my labor as soon as I join and the labor is filed by Oct 2013 (1 year before Nov 2014), am I still eligible for at least 1 year H1B extension beyond Nov 2014?
    4. Can I use my priority date from Company A? Is it true that some companies cancel I-140 petition? If so, does it mean that I will get a new priority date? Can the cancellation of I-140 by Company A add some delays or disruptions to my GC processing with Company B?

    Please help.
