Appreciate your valuable comments for my H1 related queries.
1. My H1 Visa from employer A was valid from Nov 2008 till Sep 2010.
2. I changed from employer A to employer B (Current employer) in July 2010. My H1 petition was transferred and extended for employer B. New H1 petition and I-94 are valid till March 11, 2013.
3. My employer A offered me a job in Jan 2013. Employer A filed for my H1 transfer (and probably extension as well) in premium processing. There was an RFE and we are responding to it now.
4. Since my H1 petition is valid till March 11, 2013; my current employer is insisting to submit the documents for H1 extension. My current employer will file for my H1 extension by normal processing.
I plan to quit employer B only after H1 transfer for employer A is approved. Now I have following questions, please advise.
a) Assuming my H1 transfer from employer A is approved before March 11 2013 and H1 extension is also filed by current employer. Can I quit employer B after March 11, 2013? I need to serve 30 days notice period and hence this question.
b) What happens if my H1 transfer is approved after March 11, 2013 and my H1 extension filed by current employer is still pending? Can I quit employer B as soon as my H1 transfer is approved? Or do I need to wait till my H1 extension with current employer is approved?
