H4 Stamping in India along with Spouse H1 Transfer

Me, My Wife and Kid all have valid visa till Sep-2013 from Employer A. We are visiting India for vacation during first week of Feb-13. I changed my Job to Employer-B and now all the family is planned for Stamping. However, my dependents does not have their extension filed by employer-B and Current employer says that since you are visiting your home country your dependents can attend new H4 Visa without filing extension (Since original Visa is valid for morethan 7 months and extension can be filed only before 6 months).
In the above scenrio will dependent visa will be a problem ?

None of you even need to apply for the Visa if you are returning before the current one expires.
