  • Breaking Notice Period in USA - H1B

Hi All, My company got me signed in the offer letter before sending me to USA. It states that if I need to leave company , I need to give a notice period of 90 days or $10,000.
As in USA , it is almost impossible to get more than 15 days of NP, i am badly stuck. Also my company says that it will not extend my H1 which is going to expiring in next few months. Can anyone give me some suggestion which can be helpful for me.Thanks in advance.

Find an employer and transfer your H1. Your previous employer cannot enforce such fines as they are illegal.

What is not clear in your post is, why can't you give a notice to your company and search a good job in the 90 days notice. Most full time position will take approximately 2month to clear the entire process.

Such agreements are very much legal in all states except California and your employer can sue you to demand that.
This is my opinion and not legal advice.
