  • Delay in H1B extension filing after I-140 approval

    My H1B expires on 01-Mar-2013. I got my I-140 approved a few days ago. My employer is yet to file H1B extension and I hardly have 2 business days before my H1B expires.
    What are my options if my extension is not done on or before 01-Mar-2013? Should I travel out of the country? My wife is on F1. Can I consider filing Change of status to F2? If so, what is the procedure and how soon should I file it?

    If your employer does not file H1 extension immediately, you would be out of status.

    Better to change to F2 immediately and stop working for that employer.
