  • Change of Status - B2 to H1B

    Dear Friends,

I am in need of your help, please.

My friend is travelling on a B2 visa to US from S Korea. She came 5 days back. She used to work in US in 2011 on a H1B visa, which she did for 6 months and left for S Korea.

Now, this old employer is willing to sponsor her H1B again.

Can she not switch her B2 visa to H1B visa?

    Please advice.

    Many thanks in advance.

    Best,
    ~Natalie
These are my personal thoughts. I am not a professional.

    Wishing you luck.

The discussion at the below thread should give you enough pointers as to pros and cons of doing a B2 to H1 COS. In current days of scrutiny by USCIS I personally would give less than 50% chance of a success of B2 to H1 COS. Its more advisable to get B1 to H1 approved as consular processing, go back to hoem country, get H1 stamped with the employer and return on H1.

This is my opinion not legal advice.
