H1 Cap Exemption - Need Clarification

Hi,

To avail cap exemption, you need to be on H1 status in last 6 years.. but from when does this count starts ?? is it from the day your petition approves or from the day you land in US or from the day your visa expired ??

ex.. say if you visa has approved under Cap quota from 2006-09 and if you land in US in 2007, so will it count from 2006(petition approved year) or 2007( Landed in US) or 2009 ( Visa expiry date )

Please clarify me ..

On L1B I-94 and applying for L1A-- urgent

I am on expired visa but valid I-94 till feb 2015.
My question., if i apply for L1A visa type and if it gets rejected , would my existing i-94 still be valid till its date.
