  • H4 category - 6 years completed

    Hi

I am right now working on H1B and 6 years of my H1B is getting expired in Feb 2015. I haven't started my Green Card process yet but my husband did and he has got I-140 approval.
Next year (August 2014) I am planning to convert my H1B to H4 because of family planning.

Now my question is, Can I stay on H4 visa (as dependent on my husband) after six years of my H category visa (Feb 2015) if I file my H4 extension in end of dec 2014. Or I have to leave country as I have finished 6 years of H visa and haven't started GC process.

    Please help.

    Thanks
    Disha

Only the time that you spend in the US in H1 status counts towards the 6 year limit. H4 time does not count towards that.
This is my opinion and not legal advice.
