Please help me to calculate how many years left in 6 years eligible stay in USA

    Hi,

    Please help me to understand how many years / duration left in 6 years of my eligible stay in USA. Is the the stay counted for L1B + H1B in my case or not? and also the gap between the first visit & 2nd visit 10 months, is it calculated in the stay period or not? If calculated now, how can i reclaim the unused time?

    1) L1B --> 01/01/2010 to 02/28/2010 --> 2 Months
    2) L1B --> 01/08/2011 to 10/02/2011 --> 9 Months
    3) L1B --> 10/29/2011 to 09/30/2012 --> 11 Months
    4) H1B --> 10/01/2012 to till date --> 6 Months

    My H1B is expiring on 09/19/2014 and during the new extension do i need to do something on it?

    Please suggest me based on above.

    L1+H1 Max stay can be 6 Years. Only physical stay within US is counted towards this 6 Years, any time spent outside US will not be counted towards the 6 Year allowed time. With that said , based on the dates you have mentioned you should be able to get a 2 Year H1 extension beyond 09/19/2014.

    When you go for your H1 extension, you have to provide evidences of the travel you have listed here proving that you still havent entirely used your 6 Years US stay.A good attorney should be able to draft the right documentation in this regard.
