  • H1B without petition documents

    Hi,

I have H1B stamped on my passport and doesn't have any petition documents with me and the VISA was expired in 2011? Those documents were taken by previous employer.

Can I get the H1B filed again with the petition number on VISA and get the supporting documents by new employer? or the old petition documents required?

    Regards,
    Prasanna.

Did you not keep a copy of the approval notice with you? That would have been better.

But it is not necessary. Technically on receipt number is sufficient, but some employers will insist on seeing the approval notice. You may need to convince your employer or their lawyer to accept the Visa as evidence that you previously had an H1B petition approved for you.
This is my opinion and not legal advice.
