  • H1b overstayed and now want to renter on b1/b2

    Hi,

    I have overstayed on h1b for 2 short of 180 days from i94 expiry ie., within 180 days

    Stayed outside US for more than 3 years from departure date

    Now can I renter with B1/B2(valid and not cancelled with prejudice, stamped before H1b) on company purpose

    Here would they void my b1/b2 in the system after these events

    so want to know situation at re entry in Poe

    Sr members plz suggest me on this

        What was the reason for the over stay? If it was without a corresponding extension request filed in a timely manner then though you don't trigger an automatic ban because you overstayed by less than 180 days but one never knows how the immigration officer reacts to this when you re enter. Once a misuse of a visa amounts to possibility that another similar or different visa can also be misused so you would be questioned and worst case might be deported back too. In fact there have been cases recently when the airlines itself have refused to board people who had overstayed in the past without a valid reason.

        This is my opinion it legal advice.
