Hi, I am holder of a H1B Visa the petition of which expires on Nov’14.
However on May’10 2013, I had to resign from the US company and go back to India. I joined a company in India which initiated a B1 request for me to travel to US for business purposes. Upon approval of my B1, the verification officer asked if I had changed employers and when I confirmed my status, he struck my H1B Visa and signed it.
I now have an offer from small company in the States which is wanting to get my H1B petition transferred. The consultant says that since my petition is valid I could get the same transferred to him and go for a re-stamping in any of the Indian Embassies with the new documentation.
I just wanted to confirm if this is legally possible? Though my petition is unexpired, can it still be transferred? Also are there any legal issues which i should be aware of considering the H1B visa has been struck out by the verification officer at the embassy?
