    Hello,

I lost my passport with H1B stamped visa and I-94 card, I have applied for new passport and planning to get visa stamped again during my visit to India.
My question is Can I able to travel to India without I-94 card?

    Sorry for your circumstances, Aniket.

You should seek an attorney's help. Don't take this lightly, my friend.

    Wish you luck.

    Cheers,

When did you last enter the US? Try downloading an electronic copy of your I-94.

Also, make sure you informed the Fraud Prevention Unit (FPU) of the consulate/embassy that issued your visa about the loss of your passport.
This is my opinion and not legal advice. Please consult an attorney before making any decisions.

            Hi Kadkhiq,

            Yes,

I was able to get "Admission (I-94) Number Retrieval". It has my following details:

            1) Admission (I-94) Record Number
            2) Admit Until Date:

Details provided on Admission (I-94) form:

            3) Family Name:
            4) First (Given) Name:
            5) Birth Date:
            6) Passport Number:
            7) Passport Country of Issuance:
            8) Most Recent Date of Entry:
            9) Class of Admission:

Also It is mentioned at the bottom of page that,

            * Effective April 26, 2013, DHS began automating the admission process. An alien lawfully admitted or paroled into the U.S. is no longer required to be in possession of a preprinted Form I-94. A record of admission printed from the CBP website constitutes a lawful record of admission. See 8 CFR § 1.4(d).

            * If an employer, local, state or federal agency requests admission information, present your admission (I-94) number along with any additional required documents requested by that employer or agency.

So can I use this Printed doc at the time of leaving USA?

            Regards,
            Aniket

I could not pull up my detail though. What was your most recent travel?? I know you have mentioned as Dec 2012 but just want to confirm. I heard we can download only if the most recent travel date after May 2013.

Well the rules on the CBP website say that if you were issued a paper I-94 you have to surrender it when leaving US. The rules also say that for people who have electronic records of their I-94 do not need to submit anything, their details will be pulled from the flight manifest. The rules also say that the printout of the I-94 form from the CBP website is same as official I-94. I think it is a grey area so you would need to confirm with CBP for exact details of your case. If you want to be very then safe file an I-102 with the USCIS and get a duplicate I-94, but it will cost around $325.

Exact statements form the CBP website, specifically refer to the third quote.

Travelers will not need to do anything differently upon exiting the U.S. Travelers previously issued a paper Form I-94 would surrender it to the commercial carrier or to CBP upon departure. If travelers did not receive a paper Form I-94, CBP will record the departure electronically via manifest information provided by the carrier or by CBP.

Travelers will not need to do anything differently upon exiting the U.S. Travelers issued a paper Form I-94 should surrender it to the commercial carrier or CBP upon departure. The departure will be recorded electronically with manifest information provided by the carrier or by CBP. If travelers did not receive a paper Form I-94 and the record was created electronically, CBP will record their departure using manifest information obtained from the carrier.

The I-94 website www.cbp.gov/i94 is public website travelers may visit in order to retrieve their electronic I-94 number. You may print a copy of the form. The printout from the Customs and Border Protection (CBP) website is an official Form I-94.

Thanks @snowy! From the above links it is clear that the printout of the I-94 form from the CBP website is same as official I-94. But to confirm that printout can be used instead of lost passport, Is there a number where I could contact and confirm with CBP? or I need to personally go to the Airport and talk with them?

                  Regards,
                  Amit
