  • question regarding 'bridge'

    Few facts
    1) My H1 & 194 is expiring in Nov 2013
    2) My current employer has applied for extension a week back (second half of Aug 2013)
    3) Got an offer from another company 'B'
    4) 'B' are ready to file transfer under premium processing.
    5) I am planning to inform 'A' only after visa transfer is completed.

    Questions
    1) Can I apply for transfer while my visa is still valid and applied for extension?
    2) If my visa transfer is completed and then my current employer 'A' revokes my H1, will this break the bridge?
    3) Should I get my visa extension done under premium process before applying for transfer?
    4) Are there any risk that I should be aware of?

    Regards

    Questions
    1) Can I apply for transfer while my visa is still valid and applied for extension? -- Yes
    2) If my visa transfer is completed and then my current employer 'A' revokes my H1, will this break the bridge? -- Since B's petition is filed while you are maintaining H1 status, there is no bridge.
    3) Should I get my visa extension done under premium process before applying for transfer? -- There is no need.
    4) Are there any risk that I should be aware of? -- If you join B based on receipt only, there is risk of being out of status if B's petition is denied. But that is not your plan right?

    Regards
    See above.
This is my opinion and not legal advice.

      Wow! That's great news.

No plans to join B before transfer is approved.
