H1B transfer question with goverment shutdown

Hi,

I guess this might be a unique situation, and this is my 1st post in this forum so please excuse me if i am breaking any forum rules.

I was recently let go by my employer and according to them, they had sent the termination notice to USCIS on 26th Sep.

I found another job and they are ready to transfer my H1 asap.

Now with this recent government shutdown, all H1B transfers will have to wait until the government opens up again.

What should i do?

Will my H1B stand cancelled and i will have to reapply for a new H1B? Will that new H1B be subject to the 65,000 cap which is already filled?

Will i be provided any grace period due to this weird and unique situation?

Please provide any advice.

I'm somewhat in the same situation. My file is pending for LCA approval and then was suppose to go to USCIS. Now with the US shutdown , its on hold.

I have already resigned from my company. After my last date (which is a week later) will I be out of status?

Am i allowed to stay in US when my original company files from my cancellation/i'm past my last day at office?

Will Uscis still consider H1b transfer petition when cancellation of my visa petetion has already reached Uscis?

H1B transfer question with goverment shutdown

Even I am in similar situation.

I have resigned from my current company and my last date here is 4th of October.
My LCA with new company has been filed on 19th September, and it was in pending status with DOL.Now with US gov Shutdown it is put on hold.
Without this LCA they can not proceed with my H1B filing. Hoping USCIS will allow to file without LCA temporarily.

1) Will I be out of status from 5th October, I am planning to wait here and see if everything goes fine sooner.
2) Shall I go back to India. Planning to be here for around a week to see if everything goes fine.
3) Will there be a problem in my Future Visa Transfer if I go back to India after a week(if nothing works).

I need urgent help. Please guide.

H1b Transfer Approval

Hi,

I am in somewhat similar situation. I have resigned from my current company and my last date is 11-Oct.
For me H1b transfer was applied in PP and USCIS received the same on 24-Sep and from that time till now it is showing as "Acceptance" status.
I don't know before my last date in my current company I am going to get the Approval or not.

For me too it's the same situation I am out of status since 20th Sept 13. Any idea what can be done?
