H4 to H1 and then looking for H1 transfer

  • H4 to H1 and then looking for H1 transfer

    Hello Frnds

    I have few questions regarding the visa and H1 transfer. I cam to US in jan 2013 on H4 visa with my family. I got my H1 petition approved this year from Oct 2013 till Oct 2016. I have I-94 mentioned on I-797A petition.

    1. Do I or my employer needs apply for status change form H4 to H1?? there was is no I 539 applied for COS change till now?

    2. I havnt started working yet and still looking for project from my employer A if I get an offer from employer B who is ready for my H1 transfer how soon can start working with employer B?

    3. Do I need paystubs for H1 transfer as it just started now (Oct 1) and I am not working?

    4. Suppose if I apply for H1 transfer with employer B and somehow it get rejected does my petition with Employer A holds valid?

    If you filed for Change of Status when filing for H1B, you should start working then as it is October.
