Do i need form I 824 filing for protability provision?

Hi all,

i'm about to file for a change of employer using portability provision for my H1B visa. I'm working with a lawyer who says I will have to also file form I 824 for a duplicate approval notice. Does that make sense? I can't find any infomation on it and I think it seems unnecessary or even wrong?
