Urgent: Amendment of FirstTime New H1B petition in process ? Is there such a thing?
Dear All
Firstly here is my situation:
My employer Filed my H1b indicating only one address in the petition as my work location. It was a sure thing that they company needs my service post Sept 2013. I had the job but no official letter. I received an RFE for Employer-employee relationship.
Just a few weeks back, the job and the project assigned to me at the work location with end client (indicated in H1B) was shelved. I have now have been successfully interviewed for another end client FOR EXACTLY THE SAME JOB PROFILE AND TITLE at a new location 12 miles away from the one listed in my H1B petition.
-Should I file a LCA?
- In my case, I never had H1B before. I was on H4. Would amendment apply to my case too? Can I do so now while my H1B petition is under review? I never had a H1B before.
