Hello Guys,

I just have basic questions regarding H1 processing.

I believe one's H1 petition's result will be known during the first week of April.

How long does it take to get the H1 visa and move to US ?.

I have heard that we can start working in US only in Oct even though your petition gets successfully processed in April.

Is this true ?

H1B Application acceptance Window open on First working Day of April. Even if the quota gets filled on the first day, the confirmation and subsequent petition approval is sent over the next few Months with each petition and candidate and client details examined. In 2013, with the lottery, even Master's quota, Premium processing candidates, received their Approval notices only Late May or June, and some normal processing applications are still pending even after 9 Months. So assuming that you will know the result in First week of April is over ambitious.

Now for each of these new petitions the earliest start date can be First working day Oct of the same year. If you are outside US, the earliest you can for stamping, if your petition is approved , is 90 Days before Start date. So if 01-Oct-2014 is your start date you can probably go for H1 interview July First Week. Once you get the H1 stamped in passport , the earliest you can enter US is 10 before petition start date (Sep last week). And you can commence work only from petition start date.
