  • Urgent Help - H1 Transfer

    I am working for a company A and I am on their H1 from Oct 2004. Now I got a fulltime offer from company B.

    I am getting married in Nov 2005 and I am planning to go to India and I will be back on end of Dec 2005.

    I have 2 questions -

    1) If I get my new H1 approved, would my old H1 be automatically cancelled? or does my company A should revoke my H1 manually?

    2) Visa Stamping dates are not available in India right now till feb 2006. If my new H1 gets approved, can I go in old H1 and come back and change my H1?

    Please advise.

    Hi Swetha.
    I would suggest the following to you
    1. take one appointment for you and your spouse.
    2. If new H1B approved before/during travel to India, best for both of you to get that stamped.
    3. Emergency appointments are available for returning workers.

      Thanks for the reply.

      My fiance already has his own H1 visa which is valid till end of 2006.Since I am going to India only for a month, I do not want to have this stamping issue while I am there. I am very tensed.

      Is there anyway I can track whether my visa is active or cancelled?

      My current company is American company and I am not sure whether they will cancel my visa if I give 2 weeks notice before I go to India. What would be the best thing to do? Please advise.
