L1 and H1 applicaiton at the same time from the same employer?

My employer, XYZ, is filing L-1 (individual) visa for me and XYZ is ready to file my H1 as well, if required. Usually in my organization I have observed that in case of a RFE, L1 processing takes too long, whether it is legally possible for my employer to file both L1 and H1 at the same time?
