My 1st H1-b was applied and approved in 2009, after which I switched my job and my new employer applied for H1b in 2012, the application was approved with a valid I-797 but I never got the H1-B stamped. In 2013 I quit my job and moved out of the country (USA), now I am back on a visitor visa (B2) after a year and am applying for jobs.
My I-797 is valid till 2015 but I do have new B2 visa on my passport.
My question is:
Am I subject to the H1-B visa cap in April or my I-797 can be used for a H1-B transfer?
I also checked my case status on the USCIS website and all it says is that my application has been approved.
Please let me know.
