L2 Time counted towards H1-B extension

  • L2 Time counted towards H1-B extension

    Dear Friends - My wife got a L2 VISA in August 2009. But she traveled to US in October 2011. Then she got an EAD in January 2012 and started working. Later from 01/10/2012 her status changed from L2 to H1-B, which will expire in 30/09/2015. My questions are:

    1) Would she be able to apply for H1-B extension
    2) Is the time spent on L2 counted towards her H1-B
    3) Would she be able to extend another three years after 30/09/2015.

    Please suggest.

    1. As long as her petitioner is willing, yes she should be able.
    2. No, only time spent on L1 and H1 is counted towards the 6 Years L1+h1 limitations. But time spent in L2 is counted towards the reset period, that is when one wants to reset the H1 or L1 clock by staying outside of US, they have to stay physically out, they cannot stay in US on L2/H4/or some other visa and reset the clock.
    3. Yes if thepetitioner is willing to.
