Unused H1B visa : Stamped in 2007 Nov and filing for H1B visa 2014

    Hi ,

    Please guide me and answer to my queries,
    I got H1B visa stamped in Nov 2007 but I never went to USA. It expired in Sept 2010.

    Now I am again trying to file H1B visa starting April 2014.

    My questions are as below,

    1. If I file a new petition from April 2014, will my case fall under lottery of 2014?
    2. Will my new H1b visa filing fall under cap of 65000?

    Since you were cap counted more than 6 Years back, you may not be able to reuse the old petition.

    1. While filing the I-129 you would have to mention whether you are filing as part of cap or cap exempt one.
    2. Again, if you file under cap it will be falling under the 65000 limit.

      Hi ,

      If I file new petition I-129 under cap exempt would my petition has to be selected under lottery?
      or
      there is no need to go through lottery?

        I mentioned that its unlikely that you are cap exempt.

        But if you indeed are cap exempt then your petition would be out of lottery , if at all there is a lottery.

        If you are not cap exempt, and if there is a lottery, then yes, your petition would also be part of the lottery.
